DATA CONTROLLER
The controller responsible for processing your personal data is Ferry Martina Gerardus Henricus van Dijk, trading as Ferry van Dijk Photography.
Address: Calle Don Juan de Austria 7, 1B, 29009 Málaga, Spain Email: info@ferryvandijk.com NIE/NIF: Z0923925-C
INFORMATION I COLLECT
When you contact me through this website, I may collect your name, email address, telephone number, the photography service you are interested in, and any information you include in your message.
If you decide to book a photography service, I may also process information necessary to organise and perform the assignment, manage our agreement, communicate with you, deliver the photographs and issue invoices.
Photographs and video recordings in which a person is identifiable may also constitute personal data.
The website and hosting provider may process limited technical information, such as IP addresses, browser information and server logs, where necessary for security, fraud prevention and the reliable operation of the website.
PURPOSES AND LEGAL BASIS
Your personal data may be processed for the following purposes:
To respond to inquiries and prepare a possible photography booking. This processing is necessary to take steps at your request before entering into a contract.
To organise and provide booked photography services, communicate with you, deliver photographs and manage payments or invoices. This processing is necessary for the performance of our agreement.
To meet applicable accounting, tax and legal obligations.
To protect the website, prevent misuse and maintain its security and reliability. This is based on my legitimate interest in operating a secure website.
To publish identifiable photographs in my portfolio, website or social-media channels where you have given specific permission. Portfolio or promotional publication is not required in order to book a photography service.
PHOTOGRAPHS AND PORTFOLIO USE
Photographs created as part of a booked assignment will be processed to perform and deliver the agreed photography service.
Identifiable photographs will only be used publicly for portfolio, promotional or social-media purposes where an appropriate legal basis exists. In normal client assignments, I will request separate permission before using identifiable client photographs for these purposes.
Where photographs include children, permission must be provided by a parent or legal guardian where required.
You may withdraw permission for future portfolio or promotional use by contacting info@ferryvandijk.com. Withdrawal does not affect processing or publication that was lawful before permission was withdrawn. Once a valid withdrawal request has been processed, the relevant photographs will no longer be used in new promotional material and will be removed from channels under my control where reasonably possible.
SERVICE PROVIDERS AND RECIPIENTS
I use carefully selected providers to operate the website and manage communications. These may include:
SmarterASP, for website hosting and related technical services.
Brevo, for transmitting contact-form notifications and transactional email.
Microsoft, for receiving and managing business email.
These providers process information only where necessary to provide their services and are expected to apply appropriate contractual and security safeguards.
Personal data may also be disclosed where required by law, to tax or public authorities, or where necessary for the establishment, exercise or defence of legal claims.
INTERNATIONAL TRANSFERS
Some technology providers may process information outside the European Economic Area. Where this occurs, appropriate safeguards required under applicable data-protection law will be used, such as an adequacy decision or approved contractual clauses.
RETENTION
Contact inquiries that do not result in a booking will normally be deleted within 12 months after the last meaningful communication.
Client information will be retained for the duration of the photography assignment and afterward where reasonably necessary for client service, handling possible claims and complying with legal obligations.
Invoices, accounting records and related business documentation may be retained for the periods required by Spanish tax and commercial law.
Original and delivered photographs will be retained for the period communicated in the photography agreement or for as long as reasonably necessary to provide the agreed service. Photographs published in the portfolio with permission may remain published until that permission is withdrawn or the portfolio use is discontinued.
YOUR RIGHTS
Depending on the circumstances, you may have the right to request access to your personal data, correction of inaccurate information, deletion, restriction of processing, data portability or objection to processing.
Where processing is based on consent, you may withdraw that consent at any time without affecting processing that was lawful before withdrawal.
To exercise your rights, contact info@ferryvandijk.com. I may request reasonable information to verify your identity before processing the request.
You also have the right to submit a complaint to the Spanish Data Protection Agency:
